What are my options in resolving my divorce?
In the state of Massachusetts, you have two primary options for dissolving your marriage: 1) Mediation; and 2) Litigation.
What is Divorce Mediation?
One way of obtaining a divorce in Worcester County is through divorce mediation. Divorce mediation is a method of dissolving your marriage without going to court and without having a judge make final decisions. Instead, divorce mediation allows the two parties to decide the outcome. Divorce Mediation not only offers a setting much more amicable then a courtroom, but it also is a more cost-effective way to reach a divorce agreement. Because the parties themselves, rather than a judge, negotiate the terms of their divorce, the cost is often significantly lower than when parties opt to litigate their divorce. Attorney's fees are often significantly lower as well.
Litigation
Resolving a divorce in a courtroom is quite different from doing so through mediation, as a judge will make the final ruling regarding the terms of the divorce. Whereas mediation offers parties the opportunity to negotiate the terms of their divorce, with litigation, the judge has the final say on all of the matters pertaining to the divorce.
